VUT tourist licences in Andalucía — what owners need to know

The rules on short-let licensing, community bylaws and where they are heading.

If you plan to short-let your Marbella property to tourists, you will need to register a Vivienda de Uso Turístico (VUT) with the Junta de Andalucía. The rules have tightened materially over the last two years.

The registration itself

You submit a declaración responsable to the tourism authority, meet the minimum equipment standards and receive a VUT number that must appear on every listing.

Community bylaws matter

Since a 2019 legal change, communities of owners can vote by three-fifths majority to restrict or prohibit VUT activity. Check the community minutes before you buy for short-let.

Municipal restrictions

Marbella town council has introduced additional restrictions in specific zones. Sotogrande has its own rules again.

Our view

Do not build a short-let business plan on a property until you have written confirmation from the community and the town that VUT activity is permitted at that address.
